James River Flooring is a lead generation and referral service. We operate an informational website that connects consumers in the Richmond, Virginia metro area who are seeking flooring services with local flooring companies.

Important: We do not provide flooring services, installation, or any related work. We are not flooring contractors. Our sole function is to match your consultation request with an appropriate local flooring company based on your stated needs.

2. Eligibility

You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms.

3. How the Service Works

When you submit a consultation request form through our Service:

  1. You provide us with your contact information and details about your flooring needs
  2. We review your request and match you with one local flooring company that we believe is appropriate for your needs
  3. We share your information with that flooring company
  4. The flooring company will contact you directly to discuss your project

Our involvement ends once we connect you with the flooring company. All subsequent communications, consultations, quotes, contracts, work, payments, warranties, and any other matters related to your flooring project are solely between you and the flooring company.

4. No Endorsement or Guarantee

While we make efforts to connect you with reputable local flooring companies, we do not endorse, guarantee, or make any representations about:

  • The quality of work performed by any flooring company
  • The professionalism, reliability, or conduct of any flooring company or its employees
  • The accuracy of quotes, estimates, or pricing provided by any flooring company
  • The timeliness of work or communications by any flooring company
  • Any warranties, guarantees, or promises made by any flooring company
  • The outcome of any flooring project

You are solely responsible for:

  • Verifying the credentials, licenses, and insurance of any flooring company
  • Reviewing and negotiating the terms of any contract with a flooring company
  • Making your own independent decisions about hiring a flooring company
  • Resolving any disputes or issues with a flooring company

5. Disclaimer of Liability for Third-Party Services

THIS IS IMPORTANT: James River Flooring is not responsible or liable for any acts, omissions, errors, representations, warranties, breaches, or negligence of any flooring company, or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with or services provided by any flooring company.

Your relationship is with the flooring company, not with us. Any disputes, claims, or issues arising from flooring services must be directed to the flooring company, not to James River Flooring.

6. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Provide false, inaccurate, or misleading information in any form submitted through the Service
  • Use the Service to harass, abuse, or harm another person or entity

  • ANY DISPUTES WITH ANY FLOORING COMPANY
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless RVA Online Ventures LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any information you submit through the Service

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Richmond, Virginia. You consent to the personal jurisdiction of such courts and waive any objection to the venue of any such courts.

15. Dispute Resolution

Informal Resolution: If you have any dispute with us, you agree to first contact us at Team@JamesRiverFlooring.com and attempt to resolve the dispute informally. We will attempt to resolve any dispute through informal negotiation within sixty (60) days.

No Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RVA Online Ventures LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

19. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.
